Temporary Protected Status (TPS)

There is good news and bad news about TPS. The good news is that TPS is approved for Venezuelans residing in the United States by March 21, 2021; for Haitians by May 21, 2021; and citizens of Burma by May 25, 2021 and Syria by March 19, 2021. It is very important that these individuals file their application before the completion of the initial 6 month allocation. The bad news regarding TPS is that the Supreme Court has indicated that receiving TPS is not considered an admission to apply for adjustment of status. It is important to understand that in order for a person to apply for adjustment of status, they must show that they have been admitted or paroled into the United States (with the exception of persons qualifying under 245(i)). The Court of Appeals was divided on whether persons who have received TPS can apply for adjustment of status despite having entered the United States illegally initially. However, the Supreme Court said that TPS is not considered an admission, and this closed the door for thousands of TPS holders to adjust their status.

To recap, registration periods are still open for the following countries:

  • Haiti: pending dates of the Federal Registry
  • Burma: May 25, 2021 – November 22, 2021
  • Venezuela: March 9, 2021 – September 5, 2021
  • Syria: March 19, 2021 – September 15, 2021 (first time applicants)
  • We encourage all citizens who qualify for TPS to take advantage of this benefit, consult your immigration attorney and apply for TPS immediately.
